Have you tried SupportKids.com? My mom and I went through them to collect on all the back child support that was owed....even though I was 29. He lived out of state. They were great!

Have you filled out paperwork with the Department of Social Services? I think this is how my fiance is able to get child support from our girls' bio-mother. She has a very difficult time maintaining any sort of employment but as long as she is earning a paycheck the state automatically garnishes her wages to prove him with some support $. Not really as simple as it sounds when she is jumping from job to job, but I would think it would work well if your childs father is steadily employeed.
Were you told it's out of SD's jurisdiction? If you have an established address in SD and you have custody of the minor child, then you are in the jurisdiction for SD DSS to help you out.
I am giong throught the process right now and as far as being on my end it's going smoothly. The state has to keep chasing down my ex to garnish his paycheck for the support, but they handle that on their own, I don't have to stress about it. that is not nessasarily true. I have lived here since i had my child but the court ordered child support is thru Iowa the state of his residence, they require it in order to pull the money out of his IA paycheck. This of course sucks for us as the state minimum is only $50 and South Dakota's is higher! Also all court dates are done there and i have to travel for them!!!
So anyways, i feel your pain and i have fought that fight but aside from getting a high paid lawyer there is not much i can do.
Not true, SD will garnish wages for ANY state, you just have to have the order moved here and all that is required to do that is a legal residence. Go to the SD Child Support Enforcement Website here http://dss.sd.gov/childsupport/ print the application and send it in with all the required items, they will take it from there. You can also go to the DSS office and get help filling it all out. I have 2 deadbeat dad's to deal with and they both hop from state to state, I have had child support orders in SD, ND and TX and SD is the best by far out of the three, they DO throw them in jail and take their driver's licenses when their arrearages are over $1000 also.

You've gotten the better end of the state's process then. I have a 12 yr old son who's dad is over 5000 behind and he's never been to jail and i haven't even seen his taxes since 1997 and my child support order has always been active... The worker that I have just seems to have better things to do I guess, and he still has a driv lic. Sorry I forgot to mention he doesn't make his monthly payments...and if he does they are few and far between.
I believe they only throw them in Jail if they are not keeping up with their current monthly payments. My ex owes over 6000 and still has his license and is not in jail. So far he is paying it, not sure how long it will last.
Exactly, if they are making an effort then they will let them slide some but my 19 yr old's Dad has been jailed over 10 times for child support owed when he wasn't making any effort at all (he is actually in jail right now), he used to call me mad when they would throw him in jail (like I had anything to do with it when I usually don't even know it has happened), my dead beat brother has been jailed for it 4 or 5 times in the last 5 years also.

read my post again, i was stating that the state in which the sperm donor lives in will sometimes take over the case and then SD does not have a choice nor do you! Yes SD will pull from other state and they are starting to take over orders from other states, which is ok as SD has better laws than some states but it sucks for the rest of us, as our orders are in states where the laws suck!
Jazzy is right - SD is changing the way it takes out CS. IF it is coming through another state, they might alter it to the state where it is coming from. Our case is in SD but the sperm donor lives in Iowa. If he changes jobs one more time my case worker told me she will be transferring it to Iowa court systems.

HELP! I need some legal advice...and I don't know where to turn to find it. I have a case that is out of jurisdiction for the state of SD, and therefore no lawyers in Sioux Falls will even talk with me. I don't know anything about child support, trying to collect it, or the details and legalities of it. I have a judgement in place, but it's not helping!! I feel like the court favored the biological father...who hasn't even acknowleged he had a child. They listened to him tell how he wasn't going to have any money leftover to support himself after paying the ordered support amount..........ARGGHTTHH!! Welcome to my world! The court allowed a decrease in his original support amount because poor him wouldn't have money to go golfing at the top club anymore!? I'm so overwhelmed and frustrated with the legal system...who is out there supporting single moms!!! Who's working to enforce the child support order so my child gets everything she deserves to have!? I'm a single mom, AND I have to babysit him and make sure his payments are timely and accurate etc. Help! Any knowlege and information you have learned will be helpful for me. Thanks
